1. Introduction

Welcome to FaceCraftr ("App", "Service"), a service provided by Tiera LLC ("Company", "We", "Us", "Our"). These Terms and Conditions ("Terms") govern your use of our App and its related services. By accessing or using FaceCraftr, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Use of Service

You agree to use FaceCraftr only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the App. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the App.

You must be at least 13 years old to use this Service, or such greater age required in your country to be authorized to use the Service without parental approval. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. User-Generated Content (Image Uploads)

When you upload an image ("User Content") to FaceCraftr, you retain all ownership rights to your User Content. However, by submitting User Content to the App, you grant Tiera LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process (e.g., for AI analysis), distribute (solely for the purpose of providing the Service to you), prepare derivative works of (e.g., analysis results), display, and perform the User Content in connection with the Service and Tiera LLC's (and its successors' and affiliates') business. This license is solely for the purpose of operating, promoting (in an anonymized and aggregated manner if applicable), and improving the Service.

We do not store your original uploaded images long-term beyond what is necessary to provide the service during your active session or as explicitly stated. Processed data or analysis results may be retained as per our Privacy Policy (if one is provided separately).

You are solely responsible for your User Content and the consequences of submitting and publishing your User Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish User Content you submit and that your User Content does not violate any third-party rights, including privacy and intellectual property rights.

4. AI Disclaimer

FaceCraftr utilizes artificial intelligence (AI) to analyze facial features and provide style recommendations. The analysis and recommendations provided by the AI are for informational and entertainment purposes only. While we strive for accuracy, AI technology can have limitations, biases, and may not always provide perfectly accurate or suitable results for every individual or reflect all aspects of human diversity.

The AI's output is based on patterns learned from data and should not be considered as professional advice from a stylist, dermatologist, or medical professional. Tiera LLC does not guarantee the accuracy, completeness, suitability, or usefulness of any information provided by the AI. You acknowledge that your reliance on any such information is at your own risk.

5. Beauty & Style Disclaimer

The style recommendations (hairstyles, accessories, glasses, makeup, etc.) provided by FaceCraftr are subjective suggestions intended to inspire and guide. Beauty standards and personal preferences vary greatly. What is suggested by the App may not be suitable or desired by every user and does not constitute an endorsement of any particular look or standard of beauty.

FaceCraftr and Tiera LLC are not responsible for any decisions you make based on the recommendations provided. We encourage users to consider their personal preferences, consult with professional stylists or beauty experts if desired, and use their own judgment when making decisions about their appearance. The App is not a substitute for professional advice.

6. Payment for Advanced Features

Certain features of FaceCraftr, such as Advanced AI Recommendations, may require payment. All payments are processed through our third-party payment processor (Stripe). By making a purchase, you agree to the terms and conditions of the payment processor. Prices are subject to change. We are not responsible for any fees or charges imposed by your bank or credit card issuer.

Promotion codes may be offered from time to time and are subject to the terms of the specific promotion. We reserve the right to modify or cancel promotions at any time.

7. Liability Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIERA LLC, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY DISSATISFACTION WITH THE AI ANALYSIS OR RECOMMENDATIONS.

UNDER NO CIRCUMSTANCES WILL TIERA LLC BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

TIERA LLC ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT OR AI-GENERATED OUTPUT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SPECIFIC FEATURE OF THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE DATE OF THE CLAIM, OR ONE HUNDRED US DOLLARS ($100 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

8. Intellectual Property

The Service and its original content (excluding User Content, but including the AI models as trained by Us, the design, and look and feel of the App), features, and functionality are and will remain the exclusive property of Tiera LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Tiera LLC.

9. Modifications to Terms

Tiera LLC reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect, such as by posting a notice on the App or sending an email if we have your contact information. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Tiera LLC is established (e.g., State of Delaware, USA, if applicable), without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
